By using the Chapel Gallery website & venue, you agree to comply with and be bound by these Terms, as applicable to you.

 

Who’s Who

When these Terms use the terms “Users,” “you” or “your” this refers to people who access information about, or attend Events (“Consumers”).
When these Terms use the term “Chapel Gallery,” “we,” “us,” or “our,” that refers to the Chapel Gallery, West Lancashire Borough Council its affiliates, and subsidiaries, and each of its and their respective officers, directors, agents, partners and employees.

 

What the “Terms of Service” Means

These Terms of Service and any documents referenced in them comprise Chapel Gallery’s “Terms.” These Terms are a legally binding agreement between you and West Lancashire Borough Council governing your access to and use of the service and setting out your rights and responsibilities when you use it. By using any of the gallery’s services (including browsing their website), you are agreeing to these Terms. If you do not agree to these Terms, please do not use or access the service.

    1. If you will be using the services on behalf of an entity (such as on behalf of your employer), you agree to these Terms on behalf of that entity and its affiliates and you represent that you have the authority to do so. In such case, “you” and “your” will refer to that entity as well as yourself.
    2. If you are a Consumer using the Services without a registered account, your only option for these Terms to no longer apply is to stop accessing the Services indefinitely. So long as you continue to access the Services, even without an account, these Terms remain in effect.

 

Chapel Gallery Services

 

What We Do

Chapel Gallery’s Services provide exhibitions, events and activities to visitors. These may include the undertaking of ticketing and registration, solicitation of donations, and the sale of merchandise.

 

Privacy Information

We know your personal information is important to you and it is important to the Chapel Gallery too. Information provided to us by Users or collected by cookies, is governed by ourĀ Privacy Policy.
By agreeing to these Terms of Service, you acknowledge you have read the Privacy Policy and Cookie Notice which is applicable to all Users.

 

Release and Indemnification

You agree to cover Chapel Gallery & West Lancashire Borough Council if you use the Service in a way that causes us to be the subject of a legal matter, or to face other claims or expenses, or as otherwise set forth herein, to the extent permitted by applicable laws.

 

Disclaimer

We strive to provide Services in the way you need them, but there are some things it is important for you to understand that we cannot promise.

The services, site and content are provided on an “as is” and “as available” basis.
Chapel Gallery makes no warranty that

      1. the Services (or any portion of the Services) will meet your requirements or expectations;
      2. the Services will be uninterrupted, timely, secure, or error-free;
      3. the results that may be obtained from the use of the Services will be accurate or reliable or
      4. that files you download from the site will be free of viruses or contamination or destructive features.

You understand and agree that some events may carry inherent risk, and by participating in those events, you choose to assume those risks voluntarily. For example, some events may carry risk of illness, bodily injury, disability, or death, and you freely assume those risks by choosing to participate in those events.

The Chapel Gallery shall not be liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, subsistence and accommodation relating to the Event which have been arranged by you are at your own risk.

Chapel Gallery will not be liable for any damages of any kind arising from the use of this site, including without limitation, direct, indirect, incidental and punitive and consequential damage. The foregoing disclaimers apply to the maximum extent permitted by law.

 

Intellectual Property and Copyrights

You agree that all Site Content may be protected by copyrights, trademarks, service marks, trade secrets or other intellectual property and other proprietary rights and laws. West Lancashire Borough Council may own the Site Content or portions of the Site Content may be made available to the Chapel Gallery through arrangements with third parties. Site Content included in or made available through the Services is the exclusive property of West Lancashire Borough Council and is protected by copyright laws. You agree to use the Site Content only for purposes that are permitted by these Terms and any applicable local, state, provincial, national or other law, rule or regulation. Any rights not expressly granted herein are reserved.

If you believe that any content on the Sites infringes your copyrights, you may contact us to consider removing the content in question at Chapel.Gallery@westlancs.gov.uk

 

Payments & Refunds

Payment for tickets and goods sold on chapelgallery.org.uk are in British Pounds.
Some Events will provide an option to make a financial donation as part of the booking process. You are under no obligation to make a donation.

Ticket Transfers. If you wish to transfer tickets to an event you have purchased the Chapel Gallery may be able to accommodate this for you.
Ticket Refunds. Before placing a booking, carefully review your event and ticket selection. Once purchased tickets cannot be exchanged or refunded unless the Event is cancelled, moved to another date, or if details of the Event are significantly changed after a booking is placed (significant changes being a change of headline act (concerts only), venue or show time).
It is your responsibility to comply with any age restrictions which apply to the event or the venue where the event is being held. Refunds will not be given for attendees that do not comply with these restrictions.
a. If an Event is moved from its advertised venue and / or the date, tickets already purchased may remain valid should you wish to attend the revised Event. If not, you must contact the Gallery within a week of receiving the event’s revised date.
b. Should the headline artist (concerts only) not appear or if the line up or if the content is substantially changed from that advertised at the time of purchase, you can request a refund the purchase price of your tickets. You must request this from the Gallery within a week of receiving the event’s revised headline/content, or 24 hours before the event start if this is sooner.
c. You acknowledge that, should you receive a refund for your ticket, you will discard any ticket that is delivered, and will not use it (or any copy of it) to attend the event. Violation of this constitutes fraud.

Chapel Gallery will under no circumstances be responsible for any remedy for inconvenience, consequential expenses incurred or any other loss or damages resulting from the cancellation of any Event. Please bear this in mind when making any related bookings elsewhere.

Please note, it is your responsibility to check whether the Event is going ahead at the scheduled date, time and venue.

Chapel Gallery & West Lancashire Borough Council will not be held liable under any circumstances for costs and/or damage associated with tickets arisen from situations with fraud and/or for damage associated with the purchase of the ticket through non-official means, such as third parties.

 

Your Account

We may require you to create an account to access certain features or functions of the Services. You agree to follow certain rules when you create an account or use the Services:

  • You must be at least 16 years of age. If you are 13 or older, you may only use the Services under the supervisions of a parent or legal guardian who manages your use and/or account. However, if you are under 13, please do not provide us with any information about yourself.
  • If you are using the Services on behalf of a company or other entity, you represent and warrant that you have the authority to legally bind that entity to these Terms.
  • You agree to provide true, accurate, current and complete information. You also agree to update this Registration Data if it changes.
  • You agree to immediately notify Chapel Gallery of any unauthorised use of your password or account or any other breach of security. You are responsible for (and we will hold you responsible for) any activities that occur under your account.

Notices to you may be sent via email or regular mail to the address in Chapel Gallery’s records.

The Chapel Gallery reserves the right to modify these Terms from time to time. Notices of changes to these Terms or other matters may be informed by displaying notices or links to notices to you on the Services or sending you an email or message about the modifications.

Because the Chapel Gallery has no control over such websites and resources, you acknowledge and agree that we are not responsible for the availability of such websites or resources, and do not endorse or are responsible or liable for any Content, advertising, offers, products, services or other materials on or available from such websites or resources. Nor are we liable for or any damages or losses related thereto, even if such websites or resources are connected with the Chapel Gallery partners or third party service providers.
